Terms of Use

BitaBit is a hi-fi player for iPhone distributed through the App Store. By downloading or using it, you accept these terms. If you do not agree, do not use the app.

The app is licensed, not sold. You may use it personally and on a non-transferable basis on Apple devices you own or control, subject to the App Store rules. Download and use are also subject to Apple's terms and, where applicable, its standard EULA. These terms do not reduce mandatory consumer rights.

BitaBit is a playback tool, not a content provider. You choose the local files, streams and episodes that you open, import or retain through the app.

• You are responsible for ensuring that every file you import, retain or play is yours, properly licensed, in the public domain or otherwise lawfully available for your use. Mere possession or technical availability of a file does not establish those rights.
• BitaBit and Overpal do not include, host, sell, license or supply third-party commercial copyrighted music files and do not operate an on-demand music catalogue.
• Format compatibility describes only a technical playback capability: it does not establish that a file was lawfully obtained, constitute permission, or grant or transfer rights in the work or recording.
• You may not use BitaBit to circumvent DRM, access controls or other protection measures, or to infringe copyright or any other third-party right.

You may not use BitaBit to:

• Infringe copyright, intellectual property, privacy or other third-party rights.
• Access, import or distribute content without legal authorization.
• Copy, modify, redistribute, decompile or attempt to extract the app's code, except where the law or an open-source component licence permits it.

Radio stations, podcasts, feeds, streams, artwork and metadata come from independent providers. BitaBit does not control their availability, accuracy, content or terms. A source may become unavailable if it changes, is withdrawn, blocks your region or is no longer compatible.

We work to keep BitaBit reliable, but do not promise uninterrupted operation or compatibility with every file, device or audio route. We may fix, improve, add or remove features. Apple displays current pricing, available purchases and requirements on the App Store listing.

BitaBit is provided “as is” and “as available” to the extent permitted by law. Nothing in these terms excludes warranties, remedies or rights that applicable law does not allow to be limited.

To the maximum extent permitted by law, Overpal is not liable for indirect or consequential loss arising from use of the app, loss of files or the unavailability of external services. This limitation does not apply where the law prohibits that liability from being excluded or limited.

BitaBit includes open-source software governed by its own licences. The relevant notices and credits are available in the app under Settings and take precedence for those components if there is any difference.

You may stop using and delete BitaBit at any time. Your licence may end if you materially breach these terms or the applicable App Store rules, without limiting any rights the law gives you.

We may update these terms as the app evolves or legal and App Store requirements change. We will publish the current version on this page and update the date above. If a change requires additional consent, we will request it through an appropriate channel.
